PLEASE READ CAREFULLY. By accessing earthlybenefits.net (the “Site”) or purchasing our products, you (“you,” “user,” or “customer”) agree to be bound by these Terms and Conditions (“Terms”) and all applicable laws. If you do not agree, do not use the Site.

1. About Us

Earthly Benefits Inc. (“Earthly Benefits,” “we,” “our,” or “us”) is a Canadian company offering natural, drinkable health supplements and an affiliate-based sales program.

2. Eligibility

You must be age 18 or older (or the age of majority in your province/territory) and legally capable of entering contracts to use the Site or join the Affiliate Program.

3. Account & Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use.

4. Product Information

We strive to display accurate descriptions, prices, and availability, but errors may occur. We reserve the right to correct or cancel any order affected by clerical mistakes.

5. Ordering, Payment & Taxes

  • Prices are shown in Canadian dollars unless noted.

  • Payment is processed via PCI-compliant providers (e.g., Stripe, Shopify Payments).

  • Applicable sales taxes are added at checkout based on the shipping address.

6. Shipping & Delivery

Shipping options, carriers, and estimated timelines are presented at checkout. Title and risk of loss pass to you upon our delivery to the carrier.

7. Returns & Refunds

Unopened products may be returned within 30 days of delivery. Contact support@earthlybenefits.net for a Return Merchandise Authorization (RMA). Shipping costs are non-refundable unless the return is due to our error.

8. Affiliate Program

Affiliates earn commissions on qualifying sales made through their unique referral links, subject to the Affiliate Agreement (incorporated herein by reference). We may modify commission rates, payout thresholds, or tracking methods with reasonable notice.

9. Intellectual Property

The Site, products, logos, images, and all associated content are the exclusive property of Earthly Benefits or its licensors and are protected by Canadian and international IP laws. You may not copy, reproduce, or distribute any content without prior written consent.

10. User Content & Conduct

You may post reviews, comments, or social-media content, provided it is not illegal, defamatory, or infringing. By posting, you grant us a worldwide, royalty-free licence to use, display, and reproduce that content for marketing or operational purposes.

You agree not to:
1. Violate any law or regulation;
2. Upload malware or engage in malicious activity;
3. Misrepresent product claims or medical benefits;
4. Use the Site to harass, abuse, or harm others.

11. Medical Disclaimer

Content on the Site is for educational purposes only and is not a substitute for professional medical advice. Products are not evaluated by Health Canada and are not intended to diagnose, treat, cure, or prevent disease. Consult a qualified healthcare practitioner before use.

12. Disclaimer of Warranties

The Site and products are provided “as is” and “as available.” We make no warranties—express or implied—regarding accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement.

13. Limitation of Liability

To the fullest extent permitted by law, Earthly Benefits is not liable for any indirect, incidental, punitive, or consequential damages arising from your use of the Site or products, even if advised of the possibility. Our aggregate liability will not exceed the amount you paid to us in the preceding twelve months.

14. Indemnification

You agree to indemnify and hold harmless Earthly Benefits and its officers, employees, and affiliates from any claim or demand (including legal fees) arising out of your breach of these Terms or your misuse of the Site or products.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any dispute will be resolved exclusively in the courts of Toronto, Ontario, unless you and Earthly Benefits agree to binding arbitration.

16. Modifications

We may update these Terms at any time. Material changes will be posted on this page and, where feasible, emailed to registered users. Continued use of the Site after changes constitutes acceptance of the revised Terms.

17. Severability

If any provision of these Terms is held invalid, the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy and Affiliate Agreement (if applicable), constitute the entire agreement between you and Earthly Benefits regarding the Site and supersede all prior understandings.
